Competition Denied for NSW Solicitors - Update

13 October 2025

We recently wrote to all NSW Parliamentarians to draw attention to the denial of choice and competition for compulsory insurance for the majority of NSW solicitors. A copy of the correspondence is available here.

The correspondence includes a copy of a letter sent to the Attorney General in March. The letter is available here.

The 2025 election for Councillors of The Law Society of NSW is being held with the ballot to close at 2.00pm on Monday 20 October 2025.

As at the time of sending this update, we understand four candidates (Adam Ahmed, Jacob Carswell-Doherty, Irfan Peerzada and Teezar Tirtadjaja) have specifically identified concerns with the current professional indemnity insurance arrangements as core issues.

The benefits of choice and competition (including broader and cost-effective insurance cover in a well-regulated insurance market) are recognised by the profession and will have a positive impact on the provision of and access to legal services.

We encourage you to exercise your vote in favour of those who are prepared to challenge the current arrangements to achieve that outcome.

You may also be interested to know that a group, “Solicitors for PII Choice”, is advocating for, and seeking to bring about, freedom of choice and competition for professional indemnity insurance (PII) for all NSW solicitors. More information is available here.

We are very appreciative of the tremendous ongoing support we are receiving and we remain committed to introducing choice.

We are continuing to explore further action to address the situation, including in respect of the 2026-27 practising year.
